We are often asked the question how to copyright logos.

In fact, the answer has very little to do with how to copyright logos at all but rather with the much more important subject of trademark registration.

Copyright logos or designs are usually original graphics used to denote a particular product or service. There is copyright in logos and, in the UK, at least, this will usually automatically belong to the designer, or to the company that employs the designer. So is there any need to copyright logos?

Yes. It is very important that the customer for whom the logo has been created should understand how to ‘copyright logos’ as registered trademarks because it is only in this way that the exclusive rights in a logo can be secured. The trademark registration process is basically the same for logos or ‘device marks’ as it is for normal brand names or word marks.

Intellectual property rights are often the most valuable rights that any business owns. They include trademarks, design rights, brand names, logos, patents and copyright. Logos, brands or business names can only be properly protected by registration as registered trademarks.

Of equal importance is to ensure that the copyright in any logos that have been created is assigned in writing by the designer at the time or, or prior to, payment for the design service.
