European trademark registration

The Community Trade Mark or CTM is a European trademark registration that is intended to protect your brand in all 28 Member States of the European Union.

A European trademark registration provides a broadly equivalent trademark protection to a national trademark registration in all the following countries: Belgium, France, Germany, Italy, Luxembourg, Netherlands, Denmark, Ireland, United Kingdom, Greece, Portugal, Spain, Austria, Finland, Sweden, Cyprus, Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Slovakia, Slovenia, Bulgaria and Romania.

A European trademark registration or CTM is available at a fraction of the cost of making an individual trademark registration in each of the various countries, making it an affordable trademark registration option for any business that trades(or intends to trade) with just two or three EU countries.

Another advantage of registering an EU trademark or CTM is that you can then stop competitors in other world markets registering your brand in the EU and then marketing competitive goods in Europe under the same name. Once on the market in the EU, it is often difficult stopping such goods coming into the UK under the freedom of movement of goods principles.

Moreover, if a competitor files a European trademark registration or CTM ahead of you or tries to seek registered rights in your name in any of the other Member States, you may effectively lose the opportunity to expand or sell into those markets under your own brand. Whilst you may have no current plans to do so a purchaser of your business may want the brand throughout the EU and if someone else has filed a European trademark registration ahead of you this can seriously devalue your home brand.
